Intellectual Property; This Intellectual Property Agreement (hereinafter referred to as the “Agreement”) is entered into on this date & day (hereinafter referred to as the “Purchase Date”), by and between the person Joining/Enrolling in this program (hereinafter referred to as the “Subscriber”), with an address that is on file, and Over The Horizons, LLC, with the address of PO Box 579 Neosho Mo 64850. (hereinafter referred to as “OTH”). (Collectively referred to as the “Parties”). The Parties hereby agree that the Subscriber assigns the OTH all the present and future rights and title, as well as the interest to all intellectual property (hereinafter referred to as “Intellectual Property”) that is created and/or discovered during the terms of their Subscription. Intellectual Property includes, but not limited to, trademarks, trade names, services marks, service mark registrations, service names, patents, patent rights, copyrights, inventions, licenses, approvals, governmental authorizations, trade secrets, algorithms, codes, inventions, processes, software, formulas, ideas, concepts, developments, products & services, websites, and documents. The Parties hereby agree that any intellectual property that has already been in existence prior to the Purchase Date of the Subscriber will remain the Exclusive Property of OTH in case the Subscriber has a right, title or interest in it. Herby, the Subscriber agrees that he/she will cooperate with OTH in this Agreement as reasonably as possible for the sake of obtaining the copyrights and patents that are needed for the security of OTH ownership rights in the Intellectual Property. This cooperation will last during the course of the Subscription as well as after Cancellation of Subscription. This agreement will begin on Purchase Date (Today’s Date) and will remain in effect until Cancellation of Subscription Date. After termination of this agreement, OTH will acquire exclusive ownership rights to all the Subscriber post-Subscription intellectual property that arise from or relates to his/her work for OTH in this agreement. The Parties agree that after the termination of this agreement the Subscriber will return all the tangible embodiments of the intellectual property immediately as per the order of OTH. Such include, but not limited to documents, data and notes that have or have been developed during the course of the Subscription. The Subscriber hereby agrees not to make any copies of the tangible embodiments or try to recreate them. The Parties agree not to assign responsibilities in this agreement to any third party. This agreement shall be governed by and construed in accordance with the laws of Newton County, Missouri, USA. In an event where any provision of this agreement is found to be void and unenforceable by a court of competent jurisdiction, then the remaining provisions will remain to be enforced in accordance with the Parties intention. The parties agree that this agreement will bind upon the Subscriber heirs, successors and assigns for the sake of the benefit of OTH and OTH heirs, successors and assigns. The parties agree that any amendments made to this agreement must be in writing where they must be digitally or physically signed by the Subscriber to this agreement. As such, any amendments made by the parties will be applied to this agreement. The parties hereby agree to the terms and conditions set forth in this agreement and such is demonstrated throughout by the Subscriber Checking “Yes, I Agree with the Privacy Policy and Terms & Conditions”, and also by Electronic Signature and Signature Date.

User Conduct; you agree not to use OTH Websites/&/Services or the content or information delivered through OTH Websites/&/Services in any way that would: (a) infringe any third-party copyright, patent, trademark, trade secret or other proprietary rights or rights of privacy, including any rights in the Software; (b) be fraudulent or involve the sale of counterfeit or stolen items, including, but not limited to, use of OTH Websites/&/Services to impersonate another person or entity; (c) violate any law, statute, ordinance or regulation (including, but not limited to, those governing export control, consumer protection, unfair competition, anti-discrimination or false advertising); (d) be false, misleading or inaccurate; (e) create liability for us or our affiliates or service providers, or cause us to lose (in whole or in part) the services of any of our service providers; (f) be defamatory, trade libelous, unlawfully threatening or unlawfully harassing; (g) potentially be perceived as illegal, offensive or objectionable; (h) interfere with or disrupt computer networks connected to OTH Websites/&/Services; (i) interfere with or disrupt the use of OTH Websites/&/Services by any other user; or (j) use OTH Websites/&/Services in such a manner as to gain unauthorized entry or access to the computer systems of others.

Content Ownership & Rights; All materials forming the paper based version of OTH, and all materials displayed on the Site and the Apps, including without limitation all information, text, materials, graphics, software, tools, results derived from the use of software and tools, advertisements, names, logos and trade marks on the paper based version, the Site and the Apps (Content) are protected by copyright, trade mark and other intellectual property laws unless otherwise indicated. Copyright in the Site (including text, graphics, logos, icons, sounds recordings, computer code and software) and the Content is owned or licensed by OTH. Except as expressly authorized by these General Conditions, or by legislation or statute, Users must not in any form or by any means: adapt, copy, reproduce, store, distribute, print, display, perform, publish or create derivative works from any part of the Content; or commercialize any information, products, or services obtained from any part of the Content. Users must not modify, copy, reproduce, republish, frame, download onto a computer, upload to a third party, post, transmit, share or distribute this Content in any way except as expressly provided for in these General Conditions or with our express prior written consent. Users must not use the Content for commercial purposes without first obtaining our prior written consent.

Termination & Suspension; Any interruptions to your subscription can cause your account to be paused and/or terminated. Always keep your card info Up-To-Date. If we are unable to charge your account for the subscription amount due and if your account is 2 months pass due, OTH will terminate your Account. You will receive an email that your subscription is passing due to try to fix the error. If the error is not fixed with-in a timely matter (7-10 business days) then your Account will be suspended and/or terminated. If your account is terminated all your info will be deleted. If you decide to use our services again, you will need to re-enroll as a New Customer. If you contact OTH to have your account paused, you may. What this will do is pause your subscription for 3months intervals.

OTH Right to Modify the Agreement; Over The Horizons “OTH” has the right to change this agreement and any other agreements at any time without warning. You will receive copies of any chances by VIA Mail/Email.

Disclaimer of Warranty; Goods, services, facilities, or equipment provided by OTH under this Agreement are provided “as is.” OTH makes no express or implied warranty as to the condition of any such goods, services, facilities, or equipment, or as to the condition of any research or information generated under this Agreement, or as to any products made or developed under or as a result of this Agreement including as a result of the use of information generated hereunder, or as to the merchantability or fitness for a particular purpose of such research, information, or resulting product, or that the goods, services, facilities or equipment provided will accomplish the intended results or are safe for any purpose including the intended purpose, or that any of the above will not interfere with privately- owned rights of others. Neither the government nor its contractors shall be liable for special, consequential or incidental damages attributed to such equipment, facilities, technical information, or services provided under this Agreement or such research, information, or resulting products made or developed under or as a result of this Agreement.

Limitation of Liability; The Agreement, in its current form and as amended by OTH at it’s sole discretion, constitutes the entire contract between OTH and myself. Any promises, representations, offers, or other communications not expressly set fourth in this Agreement or any subsequent amendment by OTH are of no force or effect. To the extent of any conflict or inconsistency between this agreement and the policies & procedures (in their current form or as subsequently modified), the most recent Polices & Procedures shall in all instances supersede and prevail over any term these Terms & Conditions as to the matters addressed herein. Any waiver by OTH of any breach of the Agreement must be in writing and signed by an authorized OTH officer. Waiver by OTH of any breach of this Agreement shall not operate or be construed as a waiver of any subsequent breach. If any provision of this agreement is held to be invalid or unenforceable, such provision shall be reformed only to the extent necessary to make it enforceable, and the balance of the Agreement will remain in full force and effect. This Agreement is governed by and construed in accordance with the laws of the State of Missouri unless the laws of the state in which I reside expressly require the application of its laws to this transaction (in which cases such state law shall govern). All disputes and claims relating to OTH and/or the Agreement shall be settled totally and finally by arbitration in Newton County, Missouri, or such other location as OTH prescribes, in accordance with the Federal Arbitration Act and the Commercial Arbitration Rules of the American Arbitration Association, except that all parties shall be entitled to all discovery rights allowed under the Federal Rules of Civil Procedure. All issues related to arbitration shall be governed by the Federal Arbitration Act. If a member files a claim or counterclaim against OTH, member shall do so on an individual basis and not with any other member or as part of a class action. The decision of the arbitration shall be final and binding on the parties and may, if necessary, be reduced to a judgment in any court of competent jurisdiction. The prevailing party shall be entitled to recover reasonable attorney’s fees and cost from the losing party. This agreement to arbitration shall survive any termination or expiration of the agreement. Notwithstanding this arbitration provision, OTH may apply to any court having jurisdiction for a writ of attachment, a temporary restraining order, preliminary injunction, permanent injunction or other equitable relief available to safeguard and protect OTH interest prior to during or following the filing of any arbitration or other proceeding or pending the rendition of a decision or award in connection with any arbitration or other proceeding. The parties consent to jurisdiction and venue before any federal or state court in Newton County, State of Missouri for purpose of enforcing an award by arbitration or any other matter not subject to arbitration. If the law of the State in which the applicant resides prohibits consensual jurisdiction and venue provisions for purpose of arbitration and litigation, that state’s law shall govern issues relating to jurisdiction and venue.

Likeness; I authorize OTH to use my name, picture, and/or likeness in advertising or promotional material and waive all claims for remuneration for such use. 

OTH Credit/Debit Card Terms & Conditions;

All Credit/Debit Cards must have the account holders name printed on the credit/debit card. Over The Horizons will not accept credit/debit cards drawn on banks outside the United States. In the event that any credit/debit card is returned, I agree to pay a service charge of $50, or such other service charges if the amount mandated by state law as well as any additional cost due to collection of debt as permitted by applicable law. Any orders attributed to a returned credit/debit will be cancelled immediately. Over The Horizons will pursue credit/debit card user makers who submit insufficient funds to the company to the fullest extent of the law, Use of draft method may result in orders being held until funds have cleared the bank. This Terms & Conditions (This Agreement) is a legal agreement between you (You, Your, Customer, or User) and OTH, an independent establishment of OTH. I agree to the Terms & Conditions set fourth in these terms & conditions for the use of my credit card payment information that I choose to utilize within OTH. This Agreement is between you and OTH only, and provides OTH the ability and authorization, with your consent and initiated by you, to utilize your credit card payment information for any customer initiated payments and/or purchases on any and all sites within OTH. OTH is solely responsible for the service, content and materials provided through OTH and the service generally. User acknowledge and agrees that he or she is solely responsible for and shall abide by (1) the terms of this Agreement; and (2) all policies, procedures and regulations of OTH; and (3) any cardholder, issuing bank and card brand rules. User warrants, represents and agrees that you have all legal rights to utilize the credit card information for which you are providing authorization for this purchase. This agreement shall terminate upon date that all obligations of the parties hereto with respect to this agreement have been satisfied. For returns or cancellation policies and procedures, please refer to OTH Customer Support/OTH Sales in which you are purchasing the products. Pay critical attention to these policies as they change based on where you are utilizing your credit card payment information and/or where you are purchasing products from OTH. I hereby authorize OTH to change the amount specified to the designated payment type. Refers to VISA,, Master Card, American Express, Discover and any networks that utilize these brands as getaway providers.

OTH Payment Policy;

Online: Debit/Credit Cards Only, Do Not Send Currency, All orders must be paid in full before orders can be processed. Orders Can Only Be Process Online Securely through our OTH Store/Site.

Credit/Debit Cards: Master Card, Visa Card, Discover Card, and American Express Card are all accepted, as well as all debit cards from your financial provider/bank. All orders will not be processed until your Credit/Debit Card payment has cleared. If your Credit/Debit Payment is denied then your order will be canceled. * With Website ordering, you can only pay with credit/debit card payments.

PayPal: You may pay with PayPal thru our site as well. Available at check out.

VENMO: You may choose to Pay Securely thru VENMO thru our site. Available at check out.

Gift Cards/Certificates: Only OTH Gift Cards Are able to be used on this site.

Payment Portals: *Any Payment Options made thru PayPal Pay Now, Pay Later can have a 1 week/7 day approval delay, depending on how fast you are approved and payment is made from PayPal Pay Now, Pay Later to OTH. *No order can be processed until payment has cleared 100%. 

Finance Portals: OTH offers our customer financial option thru PayPal Pay Now, Pay Later. Each financial provider has different approval steps to get you finance. At check out you will be able to select a financial provider and apply. Approval and Denial is all up to the Finance Company, they will notify you if you are approved or denied. If you are Approved and the payments have cleared, we will start processing your order. If denied, we will give you up to 2 week to try and get the order approved thru the finance company, if still not approved after the 2 weeks we will cancel the order. 

OTH Members Accounts Policy;

Members Accounts are free to create. You give gain access to your Members Account, after your account is approved, and you have successfully Pick your Subscription Plan. Your account will remain active as long as your Subscription is active. Any interruptions in your subscriptions can put your Members Account on hold. If your Subscription is Paused you will lose temporary access to your Members Account. If your Subscription has been cancelled or Non-Payment for 2 months your Members Account will be cancelled. If cancelled you will have to go thru the enrollment all over again. Pay a New Subscription.

If an Duplicate Account has been created under the Same Name, we will do either one of the options below…

  • We will Keep the Newest one and will Deactivate the Oldest One.
  • If there is an order attached to an account, we will keep that account and deactivate/delete the other account.

Deleting/Deactivating an Account;

  • If your Subscription is on pause, we will temporary suspend your Account Access until un-paused.
  • If your Subscription payment is declined for 2 consecutive months with out payment, we will Deactivate & Delete your account.
  • If your account is Deleted you will lose all your benefits and web/site access.
  • If cancelled you will have to go thru the enrollment all over again. Pay a New Subscription.
  • You can Request to have your account Cancel thru your Members Portal.
  • Spam Accounts ARE NOT Allowed and Will be Deleted & Blocked From ALL OTH Sites.

I authorize OTH to use my name, picture, and/or likeness in advertising or promotional material and waive all claims for remuneration for such use. 

Cancellation of Membership Policy;

If I choose to cancel my OTH Membership (as outlined in Policy & Procedures), or if it is voluntarily cancelled or involuntarily termination for any reason. I understand that I will permanently lose all rights as a Member. I further understand that I shall not be eligible to sell OTH products and services. I may not assign any rights or delegate any duties under this Agreement without the prior written consent of OTH. Any attempt to transfer or assign this Agreement without the express written consent of OTH renders this Agreement voidable at the option of OTH and may result in termination of my OTH Agreement and Membership. If I choice to cancel my membership at any time, I understand that I will need to contact OTH Support to complete an “Notice Or Right To Cancel” form, this form must be completely filled out and signed an dated and then mailed back to OTH Support. Once OTH Support receives this form, then they will start the Cancellation of your membership. Your membership is not fully canceled until you have receive complete confirmation that your membership has been canceled. An Membership Cancellation can take up to a month to complete. I understand that if I fail to comply with the terms of this agreement, OTH may, at it’s discretion impose upon me disciplinary action as set forth in the Policies & Procedures. If I become indebted to OTH for any reason, I authorize OTH to withhold the appropriate amounts to charge my credit cards, or debit my checking accounts, if any, which I have on file with OTH. I understand that the failure to promptly pay for products constitutes a breach of this Agreement. The term of this agreement is set upon your Enrollment Date/Subscription Plan you selected, and, unless termination, is automatically renewable. If I do not wish to renew, OTH must receive written notice at least 31days before the anniversary of the effective date. If that day falls on a weekend, notice must be received by OTH no later than 5:00p..m. CST on the Friday immediately preceding that day. Unless I notify OTH of non-renewal, or my agreement is terminated pursuant to the OTH Polices & Procedures, my agreement will automatically be renewed upon your Enrollment Date/Subscription Plan you selected. My renewal fee will be charged to the bank account or credit card of record up to 5 days prior to the anniversary date. If notice is not given and you are automatically renewed for upon your Enrollment Date/Subscription Plan you selected an you then decide to cancel your membership, the renewal fee will not be refunded.

Subscription Refunds;

Subscription CAN NOT Be Refunded, only cancelled. There is No Refunds for Cancellation of Subscriptions. There is No Refunded allowed, All Sales are final.

Please note: due to system limitations, our shipping rate structure may be different for orders placed through our website than those placed via mail paper order. As we continue to gather data on shipping costs, we may modify our website shipping rates in the future.

When you place an order, we will estimate shipping and delivery dates for you based on the availability of your items and the shipping options you choose. Depending on the shipping provider you choose, shipping date estimates may appear on the shipping quotes page.

Please also note that the shipping rates for many items we sell are price-based and/or weight-based. The price/weight of any such item can be found on its detail page. To reflect the policies of the shipping companies we use, all prices/weights will be rounded up to the next full dollar/pound.

Shipping is calculated in the shopping cart during checkout before payment is processed.

Shipping costs is calculated using the least expensive carrier based on the delivery time you select and the shipping weight of the order.

Order Processing:

We ask our customers to please allow 4-7 business days for their orders to be processed and shipped. Orders with express shipping methods are placed in priority and are shipped same day if it is submitted before 11 am CST (But not guarantied).

We cannot guarantee weekend delivery. To estimate delivery time frame, please use the delivery window of Monday – Friday.

In the event that a back order occurs, you will receive notification via email. Backorders are shipped as they become available at no additional ship charge. If you would like more information on a back ordered item, or if you prefer to cancel the back order, please email your request to support@othadultshop.com referencing your order number.

Order Tracking:

When your order is shipped, you will receive an email containing the tracking number at the end of the business day.

Packaging and Packing of Orders:

All packing and packaging of orders is done at our discretion.  This includes box sizes and weights.  This will be done within reason and shipment provider guidelines. 

Third Party Shipping Accounts:

We are unable to use third party carrier accounts for orders placed through our website.

Free Shipping:

There is NO Free Shipping Offered With Subscriptions ATM.

Insurance & Damage Claims:

All shipments are insured for their full replacement value. If you or your customer receive an item that was damaged during shipment, please contact our customer service team to arrange for a replacement. ROUTE is NOT Available on this site.

Invoices:

You will receive a invoice at the time of purchase from our site https://othadultshop.com/ you will also receive a packaging slip in your packages, and you will also receive a invoice by email once the order is 100% completed.

You packaging slips may contain the following info on them:

  • Your Name
  • Your Email
  • Your Address
  • A list of your product(s) you just bought.
    • This list will only contain Item #, Item Name, & Quantity, Not the Prices.
  • All invoices from the warehouse will have the warehouse name on the Shipping label and Packaging Slip.

OTH Warehouses:

OTH uses several different warehouse to store and ship our products to our customers. Your products maybe shipped at different times and in different packaging depending on the warehouse(s) that we ship your product from. Shipping maybe delayed due to each warehouse OTH uses to fulfill our customers orders and depending on the inventory levels per warehouse.

Product Warranty, Photos, & Description Policy;

  • From time to time, we make our mailing list available to carefully screened companies whose products might be of interest to you. If you don’t wish to receive these mailings please let customers service know., Any product that may or may not be warranty, is warranty by the product maker and not by Over the Horizons. If you have warranty questions about a product, please contact that product manufacture.
  • Product measurements may not be exact. Sizes shown are close approximations. Photographs are of the products available at the time of printing. Products may be updated, or models or equal or better value maybe substituted. Product depictions on packaging may vary slightly from the actual product because of updating, or because several models of a product are packaged in one style box. Process and items are periodically subject to change. We reserve the right to correct typographical, descriptive errors. Orders based on incorrect information are subject to cancellation.
  • Over the Horizons has the right to change product pictures, descriptions, price at anytime without notice. Over the Horizons also has the right to add, remove, or discontinue products at any time without notice.
  • If you find a typo or have any questions please ask you sales rep or call customer service. I authorize OTH to use my name, picture, and/or likeness in advertising or promotional material and waive all claims for remuneration for such use. 

Tax Exempt:

There is NO Tax Exempt Offered With Subscriptions ATM.

Warranty Information:

We offer a 30-day warranty on all of our products. We understand that returns are sometimes a necessary process when products are purchased online. With this understanding, we are happy to provide our customers with a Satisfaction Guarantee on our entire line of products.

Defective Items:
If you or your customer received a defective item, you may return it within 30 days from receipt of delivery. You will need to contact our Customer Service department at othclamsdept@oth-corp.com. In the body of the message, please reference the item number, order number and explain the defect on the item. If the defect is visible we will require photos sent to us displaying the defect on the item. Please have all this information available when contacting us.

If a replacement is desired, the defective item will be replaced upon validation of defect.

Unwanted Items:
If you or your customers are not satisfied with your purchase, for any reason, you may return it within 30 days of receipt of delivery. Note: Our Customer Service Representatives will provide a store credit for the price paid for the product minus a 40% restocking fee.

To initiate a return, please contact our Customer Service department at othclamsdept@oth-corp.com. In the body of the message, please reference the item number, and order number. Our Customer Service department will then provide you with an RMA (Returned Materials Authorization) number and instructions to proceed with the return of the item. All returns must have an approved RMA number. Unauthorized returns will not be accepted.
